“Executive Order 10 unlawful” – Supreme Court declares


The Supreme Court of Nigeria has declared as unlawful and unconstitutional the Executive Order 10 on the funding of State Judiciary and Legislature.

Most of the 7-member panel of the court agreed that President Buhari exceeded his constitutional powers in issuing the Executive Order 10.

The Executive Order 10 issued by the Buhari was then voided, and set aside by 6 out of the 7 members of the panel.

In the same vein, the Court rejected the request of the state governments for an order to compel the federal government to take up funding of capital projects for State High Courts, Sharia Court of Appeal and Customary Court of Appeal.

The Justices also refused to grant an order by the state governors to compel the federal government to pay them N66 billion being an amount they have so far spent on capital projects for the 3 courts in their respective states.
